ANALISIS KEWENANGAN PEMERINTAH KOTA BANDA ACEH DALAM BIDANG PERTANAHAN

Abstract

Penyelenggaraan pertanahan yang terjadi di Kota Banda Aceh menjadi tantangan tersendiri bagi pemerintah pada masa pemulihan dan rekonstruksi pasca bencana gempa dan tsunami tahun 2004 silam. Kewenangan pemerintahan di bidang pertanahan perlu menjadi fokus pemerintahan Kota Banda Aceh dalam menjalankan urusan wajib pemerintah yang tidak berkaitan dengan pelayanan dasar sesuai dengan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Namun, Kota Banda Aceh belum memiliki Dinas Pertanahan dalam melaksanakan urusan pertanahan dan masih di tangani oleh Sekretariat Daerah Kota Banda Aceh. Sehingga, terdapat beberapa permasalahan yang muncul dalam penyelenggaraan di bidang pertanahan. Penelitian ini bertujuan untuk mengetahui dan menjelaskan kewenangan pemerintah Kota Banda Aceh dalam bidang Pertanahan. Data yang di dapat kemudian dianalisis menggunakan teori kewenangan yang dikemukakakan oleh Philipus M.Hadjon. Menggunakan metode kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan kewenangan pemerintah Kota Banda Aceh dalam bidang pertanahan sesuai dengan Undang-Undang Nomor 23 tahun 2014 tentang Pemerintahan Daerah belum efektif pada era otonomi daerah dan hanya sebatas di fasilitasi oleh Sekretariat Daerah Kota Banda Aceh. Hal ini dikarenakan adanya kendala pada pendelegasian kewenangan yang belum penuh diberikan kepada Pemerintah Kota Banda Aceh dan masih bertumpang tindih dengan Badan Pertanahan Nasional Kota Banda Aceh, juga kendala kelembagaan dimana Kota Banda Aceh belum memiliki dinas pertanahan. Selain itu, Pemerintah Kota Banda Aceh belum memiliki sumber daya manusia yang mumpuni dan keuangan yang belum ada dalam membentuk dinas pertanahan, serta belum adanya peraturan daerah yang dirancang oleh Pemerintah Kota Banda Aceh dan Dewan Perwakilan Rakyat Daerah. Diharapkan kepada pemerintah Kota Banda Aceh untuk dapat membentuk dinas pertanahan, meningkatkan sumber daya manusia dalam bidang pertanahan secara kualitas dan kuantitas, serta adanya rancangan peraturan daerah dalam hal kewenangan pertanahan.

ABSTRACK

Land administration that occurred in Banda Aceh became a challenge for the government during the recovery and reconstruction period after the 2004th earthquake and tsunami disaster. The Authority of government in the land sector needs to be the focus of Banda Aceh government in carrying out mandatory government affairs that are not related to basic services in accordance with Law Number 23 of 2014 on Local Government. However, Banda Aceh itself does not yet have a land service in carrying out land affairs and still handled by the Regional Secretariat of Banda Aceh. Thus, there are several problems that arise in the administration in the land sector. This study aims to identify and explain the authority of Banda Aceh government in the land sector. The data obtained were then analyzed using the theory of authority proposed by Philipus M. Hadjon. Using a qualitative method with a descriptive approach, The results of the study showed that the implementation of the authority of the Banda Aceh City government in the land sector in accordance with Law Number 23 of 2014 on Local Government has not been effective in the era of regional autonomy and it facilitated by the Regional Secretariat of Banda Aceh. This is because there are obstacles in the delegation of authority that have not been fully given to the Banda Aceh Government and still overlap with the National Land Agency of Banda Aceh, as well as institutional constraints where Banda Aceh does not yet have a land service. In addition, the Banda Aceh government does not yet have qualified human and financial resources that are not yet available in establishing a land office, and there are no regional regulations drafted by Banda Aceh City Government and the Regional House of Representatives. It is hoped that the Banda Aceh government will be able to establish a land service, increase human resources in the land sector in terms of quality and quantity, as well as draft regional regulations in terms of land authority.
